Legal agreement between you and NewFans Pro

Welcome to NewFans Pro! These Terms of Service ("Terms") govern your access to and use of the NewFans Pro platform, website, and services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
To use NewFans Pro, you must:

Purchase products, access exclusive content, interact with artists
Pricing, billing, and subscription management

NewFans Pro does not accept AI-generated music for sale. Fans buy directly from artists here on the understanding that a person made the record. Selling machine-generated audio as an artist's work breaks that, so it is not permitted on this platform.

AI-assisted production on a human-authored work is fine, and always has been. That includes mastering, stem separation, noise reduction and restoration, pitch and time correction, transcription and notation, drum replacement, cover artwork, and marketing copy. Nearly every modern recording tool uses machine learning somewhere; the line this rule draws is authorship, not tooling. If people wrote it and people performed it, you can sell it here.
How this is enforced
Every music release requires you to answer “How was this music made?” before it can go live. The answer is recorded with a timestamp and kept as part of your release record. A release marked as AI-generated cannot be published for sale, and a release that is already live cannot be changed to AI-generated without being unpublished first.
Your answer is shown to fans on the release page, as “Human made” or “Human made, AI production tools”. It is a public statement about your own work, not a private note to us, and that is deliberate: it lets the people listening hold the claim to account, and it lets honest work say so.
We do not claim to detect AI-generated audio automatically, and we will not accuse you on the basis of a detector. Enforcement is your declaration plus reports from fans and other artists, reviewed by a person. If you used AI production tools, saying which ones when you publish is the fastest way to close a mistaken report.
Uploading AI-generated music gets your account banned
If you upload AI-generated music for sale, your account will be banned. That includes declaring AI-generated music as human-made. When a report is upheld by a person on our team, every release on your account is taken off sale, you can no longer publish anything, and fans who bought the release may be refunded. Fans keep what they already paid for. Bans are decided by a person after review, never by a detector, and you can appeal by writing to hi@newfanspro.com.
Scope
This restriction applies to music and audio releases. It does not apply to other products sold on NewFans Pro - animation, 3D assets, games, video, written work, or cover artwork - where generative tools are a normal part of the craft. Disclosure on those is encouraged but not required.
By uploading content, you attest that you own all rights to the content or have obtained all necessary licenses and permissions. False attestation may result in account termination and legal liability.
Failure to comply may result in content removal, account restriction, US territory blocking at 3+ copyright strikes, and potential legal liability.
IMPORTANT: If you are uploading a cover song (a recording of a song written or originally performed by someone else), you MUST obtain a mechanical license before publishing on NewFans Pro.
Mechanical License Providers:
By checking "This is a cover song" during drop creation, you acknowledge this requirement and confirm you have obtained the necessary mechanical license from the copyright holder or their authorized licensing agent.
You agree not to:
Abuse the Platform
Spam, harassment, or disruptive behavior
Circumvent Security
Hack, exploit, or bypass protections
Scrape or Copy
Automated data collection or copying
Impersonate Others
Pretend to be another person or entity
All payments are processed through Stripe. By using NewFans Pro, you also agree to Stripe's Terms of Service.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data.
NewFans Pro is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, NewFans Pro shall not be liable for:
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
This indemnification obligation survives termination of your account and these Terms. You will cooperate fully in the defense of any claim. NewFans Pro reserves the right to assume exclusive defense and control of any matter subject to indemnification by you.
If NewFans Pro is sued or faces legal action due to your content or actions on the platform, you are responsible for all legal costs, settlements, and judgments. This includes copyright infringement lawsuits, licensing disputes, and claims arising from false representations about rights ownership.
Your indemnification obligations extend to all costs incurred by NewFans Pro, including:
You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account if:
Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable period. You remain liable for any outstanding fees.
Reasons for removal may include (but are not limited to): Copyright infringement, DMCA violations, repeat infringer status (3+ strikes), violation of artist representations, fraudulent activity, payment disputes, prohibited content, legal compliance requirements, or platform abuse.
NewFans Pro is under no obligation to provide advance notice, explanation, or refunds for terminated accounts or removed content, except as required by law.
Before filing a claim, you agree to contact us at hi@newfanspro.com to attempt to resolve the dispute informally. We'll work in good faith to resolve your concerns.
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except for small claims court matters or intellectual property disputes.
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
These Terms constitute the entire agreement between you and NewFans Pro regarding the Service.
If any provision is found unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any right doesn't constitute a waiver of that right.
We may modify these Terms at any time. We'll notify you of material changes via email or platform notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
